§ 40-4. Excavation of streets, sidewalks without approval of mayor and city council prohibited; mayor authorized to institute court proceedings to halt work.

  • The mayor is hereby authorized and empowered, on behalf of the city, to institute proceedings in court, by injunction or otherwise to prevent any person from excavating any streets or sidewalks, within the corporated limits of the city, or for any purpose whatsoever, without the express permission of the mayor and city council.
