§ 22-81. Door-to-door peddlers, permit required; permit fee; hours of solicitation restricted.

  • (a)

    No house-to-house canvassing or salespersons shall solicit and/or peddle door to door in the city without first having obtained a permit from the city for such solicitation and/or peddling or canvassing.

    (b)

    The permit or license shall be $200.00 for each partnership, company, corporation or individual operating a sole proprietorship, unless the products are agricultural products purchased directly from farmers or seafood products harvested personally by the vendor or purchased directly from commercial fishermen or shrimpers, in which case the permit or license shall be $100.00.

    (c)

    Even after obtaining said permit, no such permittee shall solicit and/or peddle door to door and/or conduct any house to house canvassing or solicitation between the hours of 6:00 p.m. and 8:00 a.m., except as made by appointment.

    (d)

    Should any person having obtained such a permit, solicit and/or peddle door to door and/or conduct any house to house canvassing or solicitation between the hours of 6:00 p.m. and 8:00 a.m., except as made by appointment, then said permit shall be revoked and thereafter the said solicitor, salesperson and/or canvasser shall not be able to obtain another permit.

Sections 22-81 and 22-82 were declared unconstitutional in the United States District Court for the Eastern District of Louisiana in Civil Action No. 81-265, Section D, Mag. Div. 3, in a class action suit, the Holy Spirit Association for the Unification of World Christianity of Louisiana, Inc., et al. v. the City of Westwego. A permanent injunction against enforcement of this section was entered. As a condition of this order, members of this class agree to limit their solicitation and distribution of religious tracks door-to-door and on public streets and roadways between the hours of 9:00 a.m. and dusk within the corporate limits of the city.
