§ 38-53. Rules and regulations for facilities and/or sites.

  • Rules and regulations for the solid waste disposal facilities and/or bulk container sites and for storage containers are as follows:

    (1)

    Generally.

    a.

    The storage of all solid waste and/or other commodities or materials, shall be practiced so as to prevent the attraction, harborage or breeding of insects and/or rodents and to eliminate conditions harmful to public health or which create safety hazards, odors, unsightliness and/or public nuisances.

    b.

    The owner, whether lessor or occupant, his agent, and occupant, whether owner or lessee, of any premises shall be responsible for the satisfactory storage of all waste accumulating on or originating at that premises. A sufficient number of proper containers shall be provided by the owner, his agent or occupant to accommodate all applicable solid waste materials generated between regularly scheduled collections as may be necessary to meet the intent of subsection (1) of this section.

    c.

    All containers for storage of solid waste and/or other commodities or materials shall be maintained in such a manner as to prevent the creation of a nuisance or menace to public health, safety or welfare, including, but not limited to, unsightly litter or leakage of fluids on any premises or on any public place. Containers that are broken or otherwise fail to meet requirements of this article shall be immediately replaced with acceptable containers.

    d.

    Where garbage and similar putrescible refuse or waste is stored in combination with nonputrescible refuse or waste, containers for the storage of the mixture shall meet the requirements for garbage containers. Garbage and trash shall be drained of all free liquids and garbage shall be wrapped prior to being placed in containers.

    e.

    Bins, receptacles, other containers or stands or holders of a permanent nature above ground shall not be kept, constructed or maintained between any sidewalk or private property line and the roadway edge or curb within the city.

    (2)

    Bulk containers used with private collections. Bulk containers normally utilized with mechanical collection equipment (front, rear, or side loading solid waste collection vehicles equipped with appropriate container dumping mechanism) shall be constructed of durable rust-resistant and corrosion-resistant material, be equipped with tight-fitting lids or doors to prevent entrance of insects and/or rodents and/or other animals; and be watertight, leakproof and weatherproof.

    a.

    Containers shall be covered at all times except during the placing or removal of contents.

    b.

    Containers shall not be filled so that the lid cannot fit properly.

    c.

    The area around the containers shall be kept clean.

    d.

    No container shall be placed on the streets or public rights-of-way of the city and the placement of the container shall be the responsibility of the owner of the container.

    e.

    A fence of at least seven feet in height shall enclose all dumpsters located within the city. This fence shall be made of an opaque material such as wood, earth berm, brick, opaque hedge, etc., or any combination thereof. If the barrier consists totally or in part of plant materials, such material shall be planted in a strip of not less than five feet in width.

    f.

    The fence surrounding a dumpster shall remain closed at all times except for entering and exiting the dumpster area and from 4:00 p.m. on the day preceding a garbage collection day until 5:00 p.m. on collection day or whenever the garbage is collected.
