§ 26-1. Adoption of Louisiana Highway Regulatory Act.

  • (a)

    Pursuant to the authority conferred by R.S. 32:41(C), the city hereby adopts the provisions of R.S. 32:1 et seq., commonly referred to as the "Louisiana Highway Regulatory Act," and all regulations of the state department of highways and the director of public safety adopted pursuant thereto with respect to streets within the city, except as such are in conflict or inconsistent with this Code or city ordinances and except such as by their nature are inapplicable to the city.

    (b)

    When referring to a traffic law under this chapter, or issuing a citation or prosecuting an offense on behalf of the city under this chapter, the section number of that offense shall be cited in the following two-part numbering scheme: the first part of the section number will be the number of this chapter ("26") and the second part of the section number will be the section number of the section as listed in this chapter (i.e. City Traffic Code 26-101 Display of inspection certificates). The two-part numbering format will be separated by a hyphen, in order to designate it as a City Code violation

    (c)

    When referring to a traffic law under the provisions of R.S. 32:1 et seq., or issuing a citation or prosecuting an offense on behalf of the city under the state law the offense shall be cited using the state chapter and section number. (i.e. R.S. 32:58 Careless Operation).
