§ 40-31. Petition requirements; conditions.

  • Upon the written petition of not less than 51 percent of the property owners owning not less than 51 percent of the lineal frontage of immovable property abutting on any read or street in the corporate areas of the city, the mayor and city council may adopt a resolution giving notice of its intention to blacktop and/or its intention to provide for subsurface drainage or culverting, said road or street, provided that the following conditions are complied with:

    (1)

    The road or street to be blacktopped and/or drained by subsurface drainage or culverts has an average minimum width of at least 18 feet.

    (2)

    The road or street is at least one block in length.

    (3)

    That water and drainage are available in the petitioned area, as determined by the mayor and city council.

    (4)

    A deposit of at least 75 percent of the total cost of the black-topping and/or subsurface drainage or culverting is made with the city, by cash or certified check.

    (5)

    The number of abutting real estate owners and the property owned by them shall be determined by the conveyance records of the parish, and the number of such owners and the property which they own shall be determined as of the date of presentation of the written petition to the city council.
