§ 26-41.1. Removal of unauthorized motor vehicles on private property.

  • (a)

    The unauthorized parking or abandoning of motor vehicles on private property shall be a misdemeanor.

    (b)

    Vehicles parked on private property without proper authorization and where a sufficient number of signs have been posted declaring that parking is for authorized vehicles only may, at the request of the owner, lessee, person in control of the private property, or their agent, be removed from the private property by authorized personnel of the city and impounded at a designated place or places to be released only to the duly registered owner pursuant to the requirements and procedure set forth in this Code.

    (c)

    A "sufficient number" of signs, as required by this section, shall be as follows:

    (1)

    One sign shall be posted on private property at each entrance to the parking area as well as the entrance on each level of a multilevel parking facility, and by the entrance door to each building facing the parking area and at least one sign shall be clearly visible from each parking space.

    (2)

    One additional sign shall be posted in the parking area as follows:

    1—20 parking spaces 2 signs
    21—40 parking spaces 4 signs
    41—60 parking spaces 6 signs
    61—80 parking spaces 8 signs
    81 or more parking spaces 1 additional sign for each additional 10 parking spaces

     

    (d)

    Such signs shall be yellow and shall contain such information as the code enforcement officer shall prescribe in such rule including, but not limited to, the word "warning" and the phrase "parking only for customers, guests (or similar appropriate wording); all others will be towed." The words "warning" and the amount of the removal fee on such signs shall be in letters not less than three inches high and shall be in the color red. All other lettering on such signs shall be in letters not less than 1½ inches high and shall be in the color black.

    (e)

    Abandoned, junked or derelict vehicles discarded, parked or left standing on private property without the consent of the owner, lessee or person in control of the private property shall, at the request of the owner, lessee, person in control of the private property, or their agent, be removed from the private property by authorized personnel of the city and impounded at a designated place or places to be released or disposed of pursuant to the requirements and procedure set forth in this Code.

    (f)

    The cost for towing and removing any vehicle pursuant to this section shall be assessed in accordance with the provisions set forth in this Code.

    (g)

    Any person violating the provisions of this section shall, upon conviction, be fined in accordance with the provisions set forth in this Code.
