§ 16-85. Requirements for processing or storage of hazardous materials in bulk.

  • In the interest of the public safety of the citizens of the city, the requirements in this article shall apply to any terminal, plant, site, warehouse or yard used for the processing or storage of hazardous materials in bulk as well as the owner or operator thereof (any of which may be referred to in this article as the "plant"), whether the plant has or has not been designated by ordinance of the city council as a special permitted use for the processing or storage of hazardous materials in bulk. Each plant shall be totally responsible for the safety of its equipment and its operations. Designation as a special permitted use for the processing or storage of hazardous materials in bulk shall be based on the plant's representations to the city and shall not create for the city any liability for damages or injury related to a plant so designated.
